The National Commission for Markets and Competition (CNMC) has called for the modernization of the universal telecommunications service in Spain, highlighting the need to increase the minimum internet connection speed and improve transparency in the information provided to citizens. These recommendations arise following the direct designation of Telefónica as the operator of the universal service for the years 2025 and 2026, due to the lack of interested bidders.
Increase in Minimum Speed and New Data Limits
Currently, the minimum speed guaranteed by the universal service is 10 Mbps downstream. However, the CNMC has suggested raising this threshold to 30 Mbps, aligning with technological demands and the legal framework established by the General Telecommunications Law. Furthermore, it proposes universalizing speeds of 100 Mbps, given that 93% of fixed broadband access in Spain already reaches or exceeds this level.
Regarding data limits for connections via wireless or satellite technologies, the CNMC proposes reviewing the current limit of 45 GB/month, considering it insufficient for current needs. The recommendation is to increase it to 150 GB/month, referencing initiatives such as the conecta35 program.
Improving Transparency and Accessibility of Information
The CNMC also emphasizes the importance of making information about the universal service more accessible. It proposes that the conditions, rates, and contracting processes be grouped and clearly visible on Telefónica’s commercial website, ensuring that citizens can easily understand and access these essential services.
Clear Technical Conditions and Service Continuity
To ensure service quality, the CNMC urges the definition of clear technical conditions under which the minimum speed must be guaranteed, specifying whether it should apply under all circumstances or subject to certain network limitations.
Additionally, the direct designation of Telefónica ensures service continuity in remote and less profitable areas for infrastructure deployment. Although it would be ideal to hold a bidding process, this temporary solution addresses the urgency of maintaining connectivity throughout the national territory.
Toward a Royal Decree to Modernize the Universal Service
The regulatory body has urged the Ministry for Digital Transformation and Public Function (MTDFP) to develop a royal decree updating the conditions of the universal service to meet today’s societal needs. This includes ensuring higher speeds, adequate data limits, and greater transparency for users.
With these measures, the CNMC aims for the universal telecommunications service to fulfill its purpose of connecting all citizens, regardless of their location, and ensuring their access to essential digital services in an increasingly connectivity-dependent era.
